Summary:

Licensed midwives must report to the Office of Statewide Health Planning and Development certain information relating to the out-of-hospital births they assisted with in California. The Office must maintain the confidentiality of that information. The Office may not permit any law enforcement or regulatory agency to inspect or have copies made of the contents of any midwives' reports, for any purpose, including investigations for licensing, certification, or regulatory purposes. The Office shall report the aggregate information collected to the Medical Board of California by July 30 of each year; the Medical Board shall include this information in its annual report to the Legislature. The board, with input from the Midwifery Advisory Council, may adjust the data elements required to be reported to better coordinate with other reporting systems (e.g., the reporting system of the Midwives Alliance of North America (MANA)), while maintaining the data elements unique to California. To better capture data needed for the report required by this section, the concurrent use of systems (including MANA's) by licensed midwives is encouraged.

Summary:

Any employer of a licensed vocational nurse shall report to the board the suspension or termination for cause of any licensed vocational nurse in its employ. This required reporting shall not constitute a waiver of confidentiality of medical records.

The Board of Behavioral Sciences may deny, suspend or revoke the license of a licensed educational psychologist if he or she has been guilty of unprofessional conduct. Unprofessional conduct includes failure to comply with child abuse reporting requirements, and elder and adult dependent abuse reporting requirements.

If a hospital or facility fails to properly report cases, a department representative may access the information from the hospital or facility and report the information. Health care practitioners diagnosing or treating patients with Parkinson's disease must report each case to the department.

If a hospital or facility fails to properly report cases, a department representative may access the information from the hospital or facility and report the information. Any health care practitioner diagnosing or treating cancer in a designated cancer reporting area shall report each cancer case to the department except for cases referred or previously admitted to a treatment facility.

Summary:

Confidential information collected in the cancer incidence reporting system shall not be available for subpoena, disclosed, discoverable or compelled to be produce in any proceeding. Confidential information shall not be admissible as evidence in any court for any reason.
