Summary:

The Veterinary Medical Board has the authority to place a licensee or registrant on probation. The board may require the licensee or registrant to submit to a complete diagnostic examination by board-appointed physicians. Accordingly, if the board requires a licensee or registrant to submit to that examination, the board shall receive and consider any other report of a complete diagnostic examination given by physicians chosen by the licensee or registrant.

Summary:

In reinstating a license or registration that has been revoked or suspended, the Veterinary Medical Board may impose terms and conditions to be followed by the licensee or registrant after the license or registration has been reinstated. A licensing agency may order a licentiate to be examined by one or more physicians, surgeons or psychologists if the licentiate appears to be unable to practice his profession safely due to of an impairment caused by mental or physical illness. The examination report must be made available to the licentiate and may used as evidence in subsequent proceedings.

For a physical or mental exam performed in compliance with the court process (discovery, court order, etc), the demanding party has a right to the written report of the history, results, diagnoses, prognoses, and conclusions of the examiner, as well as a copy of the reports of all earlier examinations of the same condition of the examinee made by that or any other examiner.

Summary:

An employment agency that refers temporary licensed nursing staff to licensed health care facilities must provide the facilities with a statement that the staff person has had a health examination within 90 days prior to employment with the agency (the examination must include a medical history and physical evaluation) and verification that the staff person has had tuberculosis screening within 90 days prior to employment and annually thereafter.

On receipt of an application for disability allowance, the State Teachers' Retirement System may order a medical examination of a member to determine whether the member is incapacitated for performance of service. The medical examination shall be conducted by a physician selected by the Teachers' Retirement Board, with expertise in the member's disability. If the member refuses to submit to the required medical examination, the application for disability allowance shall be rejected.

If a governing board has reason to believe that a certificated school employee suffers from mental illness impeding the performance of duties, the board may suspend or transfer the employee.  In certain circumstances, a panel of mental health professionals shall examine the employee for fitness to discharge the job. The employee may have a personal doctor submit a report to the panel, as well.  The panel has 10 days to submit a written report on the examination to the governing board, with a copy supplied to the employee upon request.  If a majority of the panel determine that the employee should be permitted to return to work, the written report shall not be retained.

A report assessing child custody and visitation rights shall include (1) a summary of a written report from any therapist treating the child for suspected child sexual abuse, reports from other professionals, and the results of any forensic medical examination and any other medical examination or treatment that could help establish or disprove whether the child has been the victim of sexual abuse, (2) any information regarding the presence of domestic violence or substance abuse in the family that has been obtained from medical personnel or records, prior or currently treating therapists, or from interviews conducted or reviewed for this evaluation.
