If the licensing board feels that a licensed pilot is no longer fit for duty because of a health or physical condition, it may suspend the pilot's license without a hearing for no more than 40 days pending hearing and decision on the charges. The charge for suspension must be served on the pilot by the sixth day after the suspension becomes effective; otherwise, the temporary suspension terminates at the close of the sixth day.


A pilot's license may be revoked or suspended before its expiration for reasons of misconduct including, but not limited to, inability to comply with the requisite standards of health or physical condition, in which case the burden of proof of meeting these standards is on the licensee unless, prior to the hearing, he has taken and passed the requisite tests and examinations required by the Board of Pilot Commissioners for the Bays of San Francisco, San Pablo, and Suisun.
