Summary:

The Department of Health Services must conduct special investigations of the sources of morbidity and mortality and its effects on public health. The department may also be required to obtain information from other government agencies as to the effect of the conditions on public health.

Summary:

All records, written reports, and statements obtained in relation to special morbidity and mortality studies shall be confidential in regards to the identity of the individual patient and must only be used for the purposes of the study. Persons or organizations disclosing information for the studies will not be liable to any action for damages. Information may used for statistical purposes provided that individual identities are not revealed.

Notwithstanding general prohibition against disclosure, San Luis Obispo County Hospital Authority records may be accessed by legislative audit committee.

Summary:

If a state agency to a private corporation assets for the operation of a hospital, the corporation shall be subject to the general records disclosure requirements of section 101870. The corporation is not required to records if the disclosure is prohibited by state or federal law applicable to governmental and nongovernmental hospitals; (g) nor does it require the disclosure of medical files that would constitute an invasion of privacy of a patient.

Summary:

Any person may initiate proceedings to enforce his or her right to inspect or receive a copy of any record. If the court finds that records are being improperly withheld, the court shall order the office or person charged to disclose the records or show why the records should not be disclosed. The court shall examine the withheld records in camera in order to decide the case and make an order.
