An individual has a right to receive an accounting of disclosures of protected health information through an electronic health record, including disclosures to carry out treatment, payment and health care operations, for a period of three years prior to the date on which the accounting is requested.


(1) A covered entity or business associate cannot receive remuneration for any protected health information of an individual unless the covered entity obtained from the individual a valid authorization that specifies whether the protected health information can be exchanged for remuneration by the entity receiving that individual's protected health information. (2) exceptions.


Sets forth the scope of liability against any licensed health care professional, who knowingly and willfully obtains, discloses, or uses medical information of the plaintiff for financial gain. This subdivision does not limit the liability of a health care service plan, a contractor, or a provider of health care that is not a licensed health care professional for any violation of this section.
